i see your point of view, but what really helped him a little was that 2 other people testified against silva, saying they were involved in a road rage incident with silva telling the judge that silva had an anger problem and acted violent when this ocurred.I think officer white at that moment felt that his life was in danger, and probably that was his first reaction, pulling his gun.He did hit silva's son who was sitting in the back seat.White said he did not see the child. After reading all of this articles i understood the story a little more.No charges were pressed against white. In my opinion i think it was a fair decision.Yea he did wrong pulling his gun,but Silva was found dui, plus had anger management problems.

Oh ok, That sounds fair then. I didnt know she wasdui and with past incidents. He did the right thing. But shouldnt he have shot the tires. Not at the car. Just to disable the car.

yea thats true. What happened was that silva hit whites car several times and while backing up,and pointing her car toward Whites car, white then pulled his gun, thinking she was going to go straight at him,and possibly killing him.

Shooting tires won't disable the car... He acted in the right, and should have the entire backing of SDPD. Silva acted in a life threatening manner and endangered Officer white. Officer White announced himself as Off Duty SDPD, and Silva continued. After ramming Officer White's car, Officer White opened fire on Silva. I have read the court documents on this case, and they are publicly available, or at least were. I am not sure where they are available now.

Can you post a link? I would like to read the whole thing. Sounds like he did act in the right manner the more I hear about the story. Sorry, didn;t know all that when I posted that.

Ok....I'm going to say this again. We (Cops/Law Enforcement) are not Dirty Harry. We are not that great a shot, LOL! It is very difficult to hit a moving vehicles tires (Plus its usually against dept policy to shoot at tires) or hit someone's hands, or legs. We are taught to aim at the center mass (torso). So, hitting tires, hands, or legs in this case would not have been an option. Plus its is very difficult with moving target and your heart pumping thousand beats a second. We tested in training before and forget it. Dirty Harry is the MAN!!! One handed with a .44 Magnum and could take out an ant from a mile away. LOL!
The one with the road rage was not White, it was Silva. So we are clear on this one. And if someone after cutting me off and followed me into a parking lot, THEN, tried to run me over....Yep, I would have shot them, too. Yes, I would feel bad for hitting the kid, but White did not know he was in there.
We have a saying. "I rather be judged by 12 then be carry by 6" So, I believe White acted right on this one. I'm going home. Off Duty or not.

He's not. He's been on unpaid leave for the last 6 months and going through hell and stressed because of this. So, saying being treated like royalty is absurd! I don't know about you, but if someone trying to run me over and acting psychotic, I'm using whatever means I have to defend myself. A cop is essentially on duty 24/7 even when you're off duty. If you see a felony in progress, you are almost obligated to intervene. That is why we are authorized to carry off-duty. In my case, its more for my self-defense because of my previous assignments with the Gang Unit and the task force I was assigned to. But also in case I'm witness to a felony or something where someone's life is in danger.
So, with us carrying off-duty is not a power trip, but its part of our job. We are expected to do our job even where we're off. But we don't get paid for that part of it.
I hope this clarify it for some.
BTW......He can still lose his job. He is going through an Internal Affairs Investigation right now to see if he was within department policy. If he's found he's not, he would be suspended, without pay, and possible termination. So, special treatment? NO! even though he's clear by the jury, he's still can lose his job. So, special treatment he is not getting!
